Also $50 Reservation Gift Card Terms and Conditions

These Gift Card Terms and Conditions ("Gift Card Terms") govern the purchase, acceptance, and use of the Also $50.00 Reservation Gift Card (the "Gift Card").  In these Gift Card Terms, “Also,” “we,” or “us” means Also, Inc., and “you” and “your” means the cardholder who has purchased or received the Gift Card.  By purchasing, accepting, or using the Gift Card, you agree to be bound by these Gift Card Terms, collectively with any terms incorporated by reference (including our Terms of Use and the Privacy Policy).

PLEASE NOTE THAT OUR TERMS OF USE REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.  If you do not agree to these Gift Card Terms, including the aforementioned agreement to arbitrate, do not purchase or use a Gift Card.

1. General Gift Card Information

The Gift Card is a digital, stored-value card issued by Also and is designed to act as a refundable reservation or deposit for your future purchase of an Also product. Gift Cards are not credit or charge cards.  Gift cards may only be used for purchasing Also products.

The initial purchase price of $50.00 constitutes the value loaded onto the Gift Card. Gift Cards are not reloadable.

The Gift Card is delivered digitally via email, containing a unique code that can be applied as a portion of the final price of the Also product that you are purchasing at checkout. The card value is activated upon completion of your payment and our email delivery to the email address you provided when purchasing the Gift Card.  Also is not responsible for validating your email address and will send the Gift Card to the email provided in the purchase.

2. Redemption, Acceptance, and Payment

• Redemption: Invalid or unidentifiable Gift Card numbers will not be redeemed. 
• Also Product Reservation: The Gift Card code can be applied toward a portion of the final price of the Also product you wish to reserve.  Applying the Gift Card value at final purchase will reduce the total amount owed by you for the Also product.
• No Cash Redemption (Unless Required by Law): The Gift Card is not redeemable for cash, except in states where such redemption is required by law.
• Taxes:  Applicable taxes are calculated and charged at the time of redemption, not at the time of purchase of a Gift Card, unless required by law.  You are responsible for any taxes arising from use of the Gift Card.
• Payment:  Purchasing a Gift Card constitutes your express agreement to be charged using your provided payment method.  By providing Also with a payment method, you represent that you are authorized to use the payment method that you provided and that any payment information you provide is true and accurate.  In using Also’s online payment services, you authorize Also to process and display your payment information on a secured Internet site.  You are responsible for the confidentiality of your password, banking or credit card information, and any account information.  Also is not responsible for any loss you may incur if someone misuses your password, banking or credit card information, or account information.
• Administration: Also reserves the right to contract with a third party to administer Gift Cards.

3. Expiration and Refund Policy

• No Expiration:  The Gift Card never expires, and its full value will remain available until redeemed or refunded. No fees apply.
• 100% Refundable:  The Gift Card is refundable at any time for the full amount of the initial purchase price ($50.00) unless already redeemed partially or fully.
• How to Request a Refund:  To request a refund, you must contact our support team at support@also.com.  The refund will be processed back to the original form of payment used to purchase the Gift Card.  If the Gift Card has been partially redeemed, you may only request a refund for the remaining balance on the Gift Card.

4. Lost, Stolen, or Unauthorized Use

Also is not responsible for any loss or damage resulting from a lost or stolen Gift Card or from the unauthorized use of the Gift Card code. You are responsible for safeguarding your Gift Card code. Once the Gift Card code is delivered via email, you bear the risk of loss.

5. Disclaimer of Warranties; Limitation of Liability

The balance on the Gift Card is the sole liability of Also.  Also makes no warranties, express or implied, with respect to the Gift Card, including, without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event a Gift Card is non-functional, your sole remedy, and Also’s sole liability, shall be the replacement of such Gift Card.

6. Prohibited Activities

You agree not to use the Gift Card in any manner that is unlawful, misleading, deceptive, or unfair. Also reserves the right to refuse, cancel, or suspend a Gift Card and its balance if it suspects fraud, misuse, or a violation of these Gift Card Terms.

Gift Cards may not be resold.  Any resale or transfer of a Gift Card in violation of these Gift Card Terms will render the Gift Card void.  We are not responsible for Gift Cards purchased from unauthorized sellers or resellers, including auction or peer marketplaces.

7. General Provisions

• Age:  You must be eighteen years or older to purchase or use a Gift Card.
• Assignment:  We may assign these Gift Card Terms at any time without notice to you.
• Governing Law:  These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to choice-of-law principles,  except as otherwise provided in the Arbitration Agreement within the Terms of Use. 

8. Updates to Gift Card Terms

This Gift Card is issued by Also, Inc., which reserves the right to modify these Gift Card Terms at any time without notice. The most current Gift Card Terms will be available on the Also website. Your continued use of a Gift Card after changes to these Gift Card Terms constitutes acceptance of the modified terms.

9. Entire Agreement

These Gift Card Terms, together with any terms disclosed at the time of purchase (including the Reservation Terms), and our Terms of Use and Privacy Policy, which are incorporated herein by reference, constitute the entire agreement between you and Also with respect to your purchase and/or use of a Gift Card and supersede all prior or contemporaneous agreements.  In the event of any conflict between these Gift Card Terms, the Reservation Terms, our Terms of Use, and our Privacy Policy in relation to the use or purchase of a Gift Card, these Gift Card Terms shall prevail.
